SCOPE AND APPLICATION
This Privacy Policy governs the collection, use, processing, storage, disclosure, and protection of information, including personal data, in connection with the use of the Leadling Platform, its underlying infrastructure, and associated Services. By accessing, configuring, or utilizing the Platform, the User (Licensee) acknowledges and agrees to the collection and use of information in accordance with this Privacy Policy.
ROLE OF THE PARTIES
User acknowledges and agrees that, with respect to any personal data processed through the Platform—specifically concerning User’s clientele or prospective leads (“End-Consumers”)—User acts exclusively as the “Data Controller,” and Leadling acts solely as a “Data Processor.” Leadling processes personal data strictly on behalf of and pursuant to the instructions of the User as reflected through the User’s configuration and use of the Platform’s routing rules and workflow automation. Leadling does not determine the purposes or means of processing personal data and does not assume any responsibility for User’s compliance with applicable state, federal, or international data protection laws.
CATEGORIES OF DATA COLLECTED
Leadling may collect, receive, store, and process various classifications of information, including but not limited to personal data, that is provided directly by the User, submitted through the Platform, parsed from integrated sources, or otherwise generated through User activity. This data encompasses User Account Data, which includes corporate and personal identifiers necessary for account provisioning, billing, and system administration, such as names, brokerage affiliations, payment instrumentation, and electronic mail addresses. Furthermore, it includes End-Consumer Data, which encompasses information including, without limitation, names, email addresses, phone numbers, real estate search parameters, property interaction history, communication content, transaction-related timelines, and metadata associated with communications and workflows. Finally, the Platform collects Telemetry and Usage Data comprising technical and usage data, including but not limited to IP addresses, device identifiers, browser information, system logs, AI interaction logs, and feature utilization patterns across all Subscription Tiers, specifically the Basic, Core, and Advanced tiers.
We collect and process information you provide directly to us via the Services. Personal data submitted through the Services include the details you submit when you create an account, participate in any interactive features of the Services, pay for purchase orders, communicate with us via third party social media sites, request customer support or otherwise communicate with us. The types of information we may collect include your name, email address, company name, postal address, phone number and any other information you choose to provide. To the extent you provide credit card information through the Services, that information is collected and processed by our third-party payment processor pursuant to their Privacy Policy and practices. Log Files: We gather certain information about your use of the Services, including the type of browser you use, access times, pages viewed, your IP address and the page you visited before navigating to the Services, and store it in log files. We do not monitor or log data collected from your servers when using the Services, but we may log or monitor information about your access to our Services. SMS COMMUNICATIONS AND CONSENT
Leadling (“we,” “our,” or “us”) may collect and utilize a User’s mobile phone number and related consent information for the express purpose of transmitting SMS (text) messages, which may include, but are not limited to, appointment reminders, service-related notifications, and, where permitted by applicable law, promotional communications, policy updates, and claim alerts. By providing a mobile number and granting explicit consent, the User authorizes Leadling to contact them via SMS for these purposes, subject to the strict condition that such mobile numbers and consent data shall never be sold, rented, or shared with unauthorized third parties for marketing or promotional purposes. The information collected is used solely for delivering the types of SMS communications described herein and based on the User’s consent preferences, with the understanding that standard message and data rates may apply as imposed by the User’s wireless carrier. Leadling maintains appropriate security measures, including encryption and secure storage systems, to protect such personal information from unauthorized access, disclosure, alteration, or destruction, and retains such SMS consent data only for the duration of the customer relationship or until an opt-out is processed, at which point the data will be deleted or anonymized in compliance with applicable laws as set forth in this publicly accessible policy.
PURPOSE OF PROCESSING
Leadling processes collected data solely for the purpose of providing, maintaining, operating, improving, and securing the Platform and Services. Such processing includes, without limitation, the facilitation of Leadling’s proprietary lead routing architectures, calendar logic, and communication workflows, while also enabling automation logic through the execution of the Lead Priority System, Nurture Engine, and Revive AI components. Additionally, processing activities include the management of pass-through billing metrics for telecommunications and AI computation usage, alongside the provision of general system functionality, support for customer operations, monitoring of system performance, and the maintenance of operational integrity. Leadling shall not process User or End-Consumer data for independent commercial purposes unrelated to the provision of the Services, nor shall Leadling vend, rent, or commercialize such data in any manner whatsoever.
DATA ACCURACY AND USER RESPONSIBILITY
User acknowledges and agrees that Leadling does not verify, validate, or guarantee the accuracy, completeness, legality, or reliability of any data ingested into the Platform. User is solely responsible for ensuring that all data submitted to, parsed by, or processed through the Platform is accurate, lawful, and properly obtained. User represents and warrants that it has obtained all necessary rights, prior express written consents, and permissions required to collect, process, and use such data in connection with the Services, particularly regarding telecommunications regulations (TCPA, A2P 10DLC).
DISCLOSURE OF DATA AND SUB-PROCESSORS
Leadling may disclose data to third-party service providers solely as necessary to provide the Services, where such third parties process data on behalf of Leadling pursuant to strict contractual obligations. These sub-processors include, but are not limited to, GoHighLevel (GHL) for infrastructure and hosting services as the foundational database and system architecture provider; Twilio for the routing and execution of SMS, MMS, and telephonic communications; and RealtyCandy for data structuring and IDX data integration, including website behavior tracking. Furthermore, payment processing is handled through authorized gateways for the collection of Subscription Fees and usage-based pass-through costs. Leadling also reserves the right to disclose User Data where strictly required by law, regulation, legal process, court order, or governmental request, or to enforce the Leadling Master Subscription Agreement and Acceptable Use Policy.
THIRD-PARTY SERVICES
User acknowledges that the Platform may integrate with or rely upon external third-party services (e.g., external IDX brokerages, external lead generation portals via Zapier) and that Leadling does not control and is not responsible for the data handling practices, security measures, or performance of such third-party services. User’s use of any external third-party integrations is at its own risk and subject solely to the terms and policies of those respective third parties.
DATA RETENTION
Leadling retains data for as long as necessary to provide the Services, comply with legal obligations, resolve disputes, enforce agreements, and maintain operational integrity. Leadling reserves the right to retain data for backup, archival, audit, or legal compliance purposes even after the termination or cancellation of Services, subject to applicable law. Leadling further reserves the right to retain fully anonymized, aggregated metadata derived from processing activities for the perpetual enhancement of its proprietary AI algorithms and routing logic.
DATA SECURITY
Leadling implements commercially reasonable administrative, technical, and organizational measures designed to protect data from unauthorized access, disclosure, alteration, or destruction. Notwithstanding the foregoing, User acknowledges that no cloud-based system or telecommunications network can be guaranteed to be completely secure and that Leadling does not warrant or guarantee the absolute cryptographic security of User Data.
DATA BREACH INCIDENT RESPONSE
In the event of a confirmed discrete or systemic data breach affecting User Data that is directly under Leadling’s control, Leadling shall use commercially reasonable efforts to notify the User within a reasonable period of time following discovery and mitigation, to the extent required by applicable Connecticut and federal law. Leadling shall provide reasonable cooperation to the User in fulfilling the User’s regulatory notification obligations to End-Consumers.
USER RIGHTS AND REQUESTS
Individuals residing within the European Union possess specific rights regarding their personal data processed by Leadling, including the right to request access to the personal data concerned, the right to request the rectification of any inaccurate personal data, and the right to request the erasure of such data. Furthermore, EU data subjects may withdraw their consent at any time where processing is based on prior consent, and they maintain the right to lodge a formal complaint with the applicable supervisory authority. In instances where the requested data constitutes Customer Personal Information or End-Consumer Data processed on behalf of a User, Leadling may refer such requests to the applicable User in their capacity as the Data Controller and will provide reasonable support to said User in fulfilling their legal obligations to respond to the data subject
YOUR CHOICES
Users may exercise choices regarding their information by accessing, updating, or modifying account data through the Services or by contacting Leadling at support@m.leadling.com, noting that deactivation remains subject to contractual terms and legal retention requirements. Individuals whose information is processed through the Platform by a Leadling User should direct all requests for access, modification, or deletion to the applicable User as the primary Data Controller. Regarding technical data, while most web browsers are configured to accept cookies, Users may adjust browser settings to reject them, though such actions may impair Service functionality. Additionally, Users may opt out of promotional communications by following the provided instructions or contacting support, although non-promotional communications regarding account status or the business relationship will continue to be transmitted as necessary.
LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Leadling shall not be liable for any unauthorized access to, alteration of, or loss of User Data, except to the extent directly caused by Leadling’s willful misconduct or gross negligence. In no event shall Leadling be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to data processing, telecommunications filtering, or security incidents.
MODIFICATIONS
Leadling reserves the right to modify or update this Privacy Policy at any time to reflect changes in regulatory requirements, Sub-Processor architecture, or Platform features. Continued use of the Platform following the posting of any changes constitutes explicit acceptance of such modifications.
